If your action is too high, you can't intonate the guitar. I would get the neck squared away and then get the middle of the saddle positioned to yield the correct scale length. That is, the distance from the speaking side of the nut to the middle of the 12th fret will be very close to equal to the distance from the middle of the 12th fret to the contact point of the saddle.
